Increasing workers’ benefits with collective bargaining agreement

(BGO) - The collective bargaining agreement (CBA) is an important legal framework for the trade union to build harmonious labour relations and prevent labour dispute. Thus, trade unions at all levels in Bac Giang province have negotiated, signed and supervised implementation of CBAs in enterprises providing more benefits for labourers.

87 percent of enterprises sign CBA

According to the Division of Legal policy and Labour Relations, the provincial Confederation of Labour, 546 enterprises in the province negotiated, signed, amended and supplemented the CBAs, accounting for 87 percent of the total number of enterprises with trade union. Particularly, 57 new CBAs were signed in 2021.

According to Diem Bich Lien, Head of the Division of Legal policy and Labour Relations, 80 percents of the CBAs have from 3 to 5 contents excluded from the legal regulations benefiting labourers, for example shift meal, welfare visit and allowance for sudden difficulties.

Particularly, Haem Vina Company Limited in Song Khe - Noi Hoang industrial park (IP) provides vitamins for pregnant workers. Bac Giang LGG Garment Corporation in Lang Giang district and Crystal Martin Vietnam Company Limited in Quang Chau IP provide their workers with 1 bottle of fresh milk everyday to supplement nutrition.

Luxshare ICT Company Limited in Van Trung IP, which has the largest number of trade union members with about 26,000 people, established the trade union executive board and signed the CBA right after coming into operation in 2019. With the large number of workers, the company gives top priority for preventing labour dispute.

In the CBA applied by the company, in line with implementing some compulsory regulations, the employer provides 300,000VND (13.04 USD) of transport allowance, 500,000 VND (21.7 USD) of accommodation allowance and 400,000 VND (17.4 USD) of seniority bonus for each employee per month while supplementing nutrition and regularly changing menus of shift meals for the workers.

Promoting roles of grassroots trade unionists

When evaluating quality of the CBAs in the province, Nguyen Van Bac, Vice Chairman of the provincial Confederation of Labour said: Many enterprises do not pay attention to quality of the signed CBAs with contents copied from some compulsory regulations or unspecific terms and provisions and they do not timely amend and supplement the CBAs when the relevant legal documents have been changed or welfares related to workers arise.

In case enterprises have not established trade unions, the upper-level trade union will take in charge of negotiating with the employees. In fact, not many CBAs in the province are signed under this form. The Confederation of Labour of Hiep Hoa district is the first unit in the province negotiated and signed CBA at Vina Prauden One Member Company Limited in Danh Thang commune in 2018 when this company had not establish the trade union.

A qualified CBA greatly depends on roles of the trade unionists. In order to improve the quality and percentage of the signed CBAs, the trade union needs to pay attention to training skills of the grassroots trade unionists in the enterprises, establish consulting teams of the trade unions at all levels in this issue to support and provide guidance on procedures especially raising the employers’ awareness of the collective bargaining agreement.

Besides, they should collaborate with related agencies to foster investigation, inspection and supervision on implementation of the law on employment and trade union and heighten responsibilities of the parties in implementation of the agreement targeting to protect benefits of the trade union members and labourers.
